These Terms of Service ("Terms") form a binding agreement between you and Sheriax, operating from India ("we", "us", or "our"), the publisher of Kindred, a private family tree and memory-sharing application (the "Service"). By creating an account or using the Service, you accept these Terms.
1. Acceptance
By registering for or using Kindred, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Your account
- You must be at least 18 years old to register an account, or a minor with the verifiable consent of a parent or lawful guardian as required by the Digital Personal Data Protection Act, 2023.
- You are responsible for keeping your sign-in credentials safe and for all activity that takes place under your account.
- You agree to provide accurate information about yourself and the relatives you add, and to update it when it changes.
3. Acceptable use
You agree not to use the Service to:
- Harass, bully, threaten, stalk, or impersonate another person.
- Upload, share, or transmit material that is unlawful, defamatory, obscene, hateful, or that infringes any third party's intellectual property or privacy rights.
- Upload, share, or transmit any content that sexualises minors or constitutes child sexual abuse material.
- Send spam, chain messages, or unsolicited commercial communications.
- Scrape, crawl, or harvest data from the Service; reverse-engineer or attempt to derive source code; or circumvent any security or rate-limiting mechanisms.
- Add a person to a family tree without a reasonable, good-faith belief that they are in fact related to you.
- Use the Service to violate any applicable law.
We may suspend or terminate your access at any time if we believe you have breached these rules.
4. Your content
You retain all intellectual property rights in the photos, videos, audio, text, and other material you upload to the Service ("Your Content").
You grant Kindred a limited, worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and transmit Your Content solely as necessary to operate the Service for you and for the relatives you choose to share it with. We do not claim ownership of Your Content and we do not use it to train any machine-learning model without your separate, express consent.
You represent and warrant that you have all rights needed to upload Your Content and to grant us the licence described above, and that Your Content does not violate the rights of any third party.
5. Termination
You may delete your account at any time by following the process in Section 7 of our Privacy Policy (email support@kindredtree.app with the subject "Account deletion request — Kindred"). We may suspend or terminate your account if you breach these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to harm.
6. Intellectual property
The Kindred name, logo, visual design, application code, and all related materials (other than Your Content) are the exclusive property of Sheriax. These Terms do not grant you any right to use any of those marks or materials other than as strictly required to use the Service for personal, non-commercial purposes.
7. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular content will always be available.
8. Limitation of liability
To the fullest extent permitted by applicable law, Sheriax, its affiliates, and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claim arising out of or in connection with these Terms or the Service shall not exceed the greater of (a) the total amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 1,000. The Service is currently free of charge.
9. Governing law and jurisdiction
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. You and we agree that the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you in-app and by email, and update the “Last updated” date above. Your continued use of the Service after a change means you accept the updated Terms.
